Privacy Policy

This Privacy Policy (this "Policy") describes the practices of Virtue Tank, LLC, a Florida limited liability company ("Company", "we", "us", or "our") with respect to the collection, use, disclosure, retention, safeguarding, and disposal of personal information in connection with the ThirteenEight website and application (the "Service"). By accessing or using the Service, you acknowledge the practices described herein. This Policy is incorporated by reference into our Terms of Service.

1. Categories of Information We Collect

Information you furnish. In connection with account registration and use of the Service, we collect: first and last name; email address; telephone number; state of residence; mailing address; account credentials (retained solely in hashed form); the dispute particulars you enter, including creditor names, the last four (4) digits of account numbers, descriptions of reported information, and the corrections you assert; mailing dates, tracking numbers, and records of bureau responses; and any documents you elect to upload, including consumer reports and bureau correspondence.

Information we do not solicit. We do not request or require your full Social Security number, complete account numbers, or bank or payment card information, and you are instructed not to furnish them. Wherever such information appears in an uploaded document or machine-generated output, we employ automated measures to mask Social Security numbers prior to storage; however, we do not warrant that all sensitive information will be detected and redacted.

Information collected automatically. Our hosting providers automatically log technical data, including Internet Protocol address, browser and device characteristics, and pages requested, for purposes of security, integrity, and service reliability. We do not deploy third-party advertising trackers within authenticated areas of the Service.

2. Purposes of Collection; Use of Information

We process personal information for the following purposes:

  • to establish, maintain, secure, and authenticate your account;
  • to prepare dispute letter drafts from facts you enter and confirm;
  • to provide optional AI-assisted features you request, as more fully described in our AI & Service Disclosure;
  • to retain your letters, mailing records, and response records for your tracking purposes;
  • to transmit service-related communications and, subject to your opt-in consent, reminders or marketing communications;
  • to detect, prevent, and respond to fraud, abuse, and security incidents;
  • to comply with applicable legal obligations and to enforce our Terms of Service.

We do not sell your personal information, nor do we share it for cross-context behavioral advertising purposes.

3. Disclosure of Information

We disclose personal information solely as set forth below:

  • Service providers and processors that host our application, database, and file storage, and that furnish AI processing services, in each case acting under contractual obligations to safeguard such information and process it solely on our instructions;
  • Legal process and compelled disclosure, where we in good faith believe disclosure is required by applicable law, regulation, legal process, subpoena, or court order, or is necessary to protect the rights, property, or safety of you, the Company, or others;
  • Corporate transactions, in connection with any merger, acquisition, reorganization, or sale of assets, subject to the protections of this Policy;
  • With your direction or consent.

Under no circumstances do we transmit your letters to any Consumer Reporting Agency, creditor, or Furnisher. You mail your letters yourself.

4. Data Security

Personal information is encrypted in transit and at rest by our hosting providers. Uploaded documents reside in private storage accessible only through your authenticated session, and database records are access-restricted to your account. Notwithstanding the foregoing, no method of transmission or storage is absolutely secure, and we cannot guaranty perfect security against all unauthorized access, use, or disclosure. You are responsible for maintaining the confidentiality of your credentials.

5. Data Retention and Disposal

We retain your account information, letters, and records for so long as your account remains active or until you delete them. Upon deletion, data is removed from active systems; residual copies may persist in encrypted backups for a limited period prior to being overwritten in the ordinary course. We may retain limited records — including consent records and security logs, which do not contain document contents — for such periods as necessary to satisfy legal obligations, resolve disputes, and enforce our agreements.

6. Your Privacy Rights and Choices

  • Access and portability: download a copy of your records from Account & Privacy.
  • Correction: update your profile information at any time.
  • Deletion: delete your documents and records and request deletion of your account.
  • Communications preferences: opt out of marketing communications at any time; transactional service messages may continue.

Depending upon your jurisdiction, you may enjoy additional rights under applicable state privacy statutes, including without limitation the rights to know, to delete, to correct, and to be free from discrimination for the exercise of any such right. To exercise any right, contact us using the details set forth below. We will verify your identity prior to responding to any request and shall not discriminate against you for exercising any right afforded by law.

7. Children's Privacy

The Service is intended solely for individuals eighteen (18) years of age or older. We do not knowingly collect personal information from children under thirteen (13) years of age, consistent with the Children's Online Privacy Protection Act, 15 U.S.C. § 6501 et seq. If you believe a minor has furnished us personal information, contact us and we will promptly delete such information.

8. Amendments to this Policy

We may amend this Policy from time to time in our discretion. In the event of a material amendment, we will provide prospective notice by email or through the Service prior to its effective date. The effective date set forth above reflects the date of last revision.
